TrueSit terms of use
Version 1.0. Effective October 17, 2026.
Your company is responsible for any notice and consent the law requires before recording.
1. Who these terms bind
These terms are an agreement between DMS Consultation Inc., a California corporation in Los Angeles, California ("TrueSit", "we"), and:
- the organization that opens a TrueSit account (the "Organization");
- each person the Organization adds as a user.
They cover the TrueSit phone and watch apps, the web dashboard, the website and the API (the "Service"). An order form signed by both parties wins over these terms where they conflict. The Data Processing Addendum (https://truesit.ai/privacy/#dpa), the acceptable use policy (https://truesit.ai/terms/#acceptable-use) are part of these terms.
2. Words we use
- Sit: one recorded sales appointment, from the door to the close or the end of the visit.
- Homeowner: anyone at a sit who is not the rep, including other household members and anyone at the door during a canvass session.
- Consent line: the short statement the rep says before recording, chosen by the Organization's consent table for the appointment's state.
- Voiceprint: the voice embedding made from a rep's enrollment, used only to tell the rep's voice apart in their own sits.
- AI output: anything the Service generates with AI: transcripts, speaker names, stages, findings, reasons, summaries, Mentor and Level answers, drafts.
- Customer Data: recordings, photos, transcripts, AI output and other data the Organization or its users put into or create in the Service.
- Org admin: a user the Organization lets manage its account.
3. Accounts
- Users must be 18 or older and give accurate details.
- Org admins are responsible for the users they add, the roles they give and removing people who leave.
- Keep sign-in methods safe and tell us at support@truesit.ai if you think an account was used without permission.
- The Organization is responsible for what happens under its account.
4. Recording with consent
The Organization and the rep are responsible for obtaining consent. The app shows the consent reminder before the sit. The rep may confirm "I said it" to record the time and version, but recording never waits for this confirmation. Analysis flags a missing disclosure without holding, hiding or deleting the sit. The homeowner can ask for the recording to be deleted.
The Organization:
- keeps its consent table current for every state where its reps work, starting from the default in the compliance kit (https://truesit.ai/terms/#compliance-kit);
- trains its reps to use the consent step, to say the line before recording, and to follow the acceptable use policy;
- makes sure consent is obtained where the law requires it, including for live listening by its managers; and
- answers homeowners' requests about recordings it holds, with our help.
Each rep:
- says the consent line where the app asks for it and confirms it in the app only after saying it;
- stops recording at once when anyone asks, and does not record anyone who refused;
- tells anyone who joins mid-visit that the visit is being recorded;
- in a canvass session, says the door line at each door before the conversation is kept; and
- in a Ride-along sit, uses the line that names live listening.
The Service provides the consent step, the state's rule from the Organization's table and a record of what was said. These are tools; they are not legal advice, and we do not decide whether a recording is lawful.
5. Voiceprints
The phone app requires voice enrollment to finish onboarding. The Organization must obtain the rep's written release before enrollment. The rep agrees to the voiceprint release before enrolling. A rep who does not wish to enroll should contact the Organization or support@truesit.ai before using recording features. The Organization may not require enrollment as a condition of employment or penalize a rep who declines. Voiceprints are kept and destroyed as the voiceprint policy (https://truesit.ai/privacy/#voiceprint) states; the Organization may shorten the period within the published range but not extend it.
6. Employer duties
Where reps are employees or contractors, the Organization is responsible for:
- giving the notices of electronic monitoring its states require, and getting acknowledgments where required;
- giving the notices required where AI is used in employment decisions, and offering a human review where the law requires it;
- never using AI output as the only basis for hiring, discipline, pay or termination; and
- reviewing the evidence (the transcript moments behind a finding) before acting on it.
The compliance kit contains templates the Organization may adapt. They are starting points, not legal advice.
7. Acceptable use
Users must follow the acceptable use policy. We may suspend use that breaks it, as section 21 describes.
8. Customer Data
- Ownership. The Organization owns its Customer Data. Between the Organization and its users, the Organization controls it.
- Our licence. The Organization gives us a limited licence to host, process, transmit and display Customer Data only to provide, secure and support the Service, and to improve it only as the next point allows.
- Product improvement. We use the contents of recordings and transcripts to improve the Service only when an org admin turns on the product improvement switch (off by default). We never sell Customer Data and never let our providers train their own models on it.
- Processing terms. The DPA governs how we process personal information in Customer Data.
- Export and deletion. Org admins export Customer Data at any time from Settings. After an account closes, we delete Customer Data as the retention schedule states.
- Data that leaves. When the Organization sends data out of the Service, through exports, downloads, API tokens, webhooks or a CRM connection, that copy is its responsibility. We log each export and download.
9. AI output
AI output is decision support. It can be wrong or incomplete. Each finding links to the transcript moment behind it, and confidence is shown where we have it. Users review the evidence before relying on AI output, and the Organization decides what to do with it.
10. Plans, seats, AI budget and recording hours
- Each plan includes the features and limits shown at purchase or in the order form. We do not publish prices on the website; the price is in the order form or shown before purchase.
- Organization plans are billed per seat. Adding a seat is prorated; removing one stops its renewal at the end of the period.
- Each organization has a monthly AI budget. When it is used up, new Level questions, Quick recaps and practice sessions wait until the next month or until the Organization adds budget. Recording never stops.
- Recording hours are pooled across the Organization's seats each month. Past the pool, new sits are kept safely but wait to be processed until a seat is added or the month turns. Recording never stops.
- If the Organization stops paying or a trial ends, the account becomes read-only: recording and processing continue, while invitations, playbooks and settings are locked until payment.
11. Renewal and cancellation
- Subscriptions renew automatically, monthly or yearly, as shown before purchase, until cancelled.
- The Organization cancels through its billing page or by contacting support@truesit.ai under its order form. Cancelling stops the next renewal; access continues to the end of the paid period.
- Before a yearly plan renews, we send a reminder with the date, the amount and how to cancel.
- We give at least 30 days' notice before a price change takes effect, and the new price applies from the next renewal.
- A trial converts to a paid plan only on the terms shown when it started.
12. Refunds
Fees are not refundable except where the law requires it, or where we end the Service for our convenience (we then refund the unused prepaid part).
13. Availability and support
- We work to keep the Service available but do not promise uninterrupted service unless an order form does.
- Recordings are stored on the phone until they upload, so an outage on our side does not lose a sit.
- We announce planned maintenance in advance where it affects use.
- Support: in-app Help, the help center and support@truesit.ai. We aim to reply within the target set for the Organization's plan, shown in the order form.
14. Security and incidents
We protect Customer Data as the DPA and the security overview (https://truesit.ai/privacy/#security) describe, and notify the Organization of a security incident affecting its data as the DPA states.
15. Other services
Sign-in with Google or Apple, app stores, and the Organization's own CRM or other systems are governed by their providers' terms. We are not responsible for them, or for data once it reaches them.
16. Intellectual property and feedback
The Service, the TrueSit brand, our software and our templates belong to us or our licensors. The Organization's own playbooks and material belong to the Organization. If you send us feedback or ideas, we may use them without obligation to you.
17. Confidentiality
For organization accounts, each party keeps the other's non-public information confidential, uses it only to perform under these terms, and protects it with reasonable care. This does not cover information that is public, already known, independently developed or lawfully received from someone else, and allows disclosures the law requires with notice where allowed.
18. Warranties and disclaimers
Each party warrants it has authority to enter these terms. The Organization warrants that it has the rights and gives the notices needed for the Customer Data it puts into the Service, including the recordings its reps make. Apart from the express promises in these terms and the DPA, the Service is provided as is, and we disclaim implied warranties to the extent the law allows.
19. Limitation of liability
- Neither party is liable for indirect, incidental, special or consequential damages, or lost profits or sales.
- Each party's total liability is limited to the fees paid or payable in the 12 months before the claim.
- These limits do not apply to: the Organization's indemnity for recording and consent claims in section 20; either party's fraud or wilful misconduct; or amounts owed for the Service.
- These limits do not apply to our liability for a security breach of Customer Data caused by our failure to meet the DPA.
20. Indemnities
- The Organization will defend and indemnify TrueSit against third-party claims arising from recordings its users made, including claims that consent or notice was missing, and from its users' breach of the acceptable use policy or its own employer duties.
- TrueSit will defend and indemnify the Organization against third-party claims that the Service, used as allowed, infringes their intellectual property, and against claims arising from our breach of the DPA's security duties.
- The party seeking indemnity gives prompt notice, lets the other control the defense and cooperates.
21. Suspension and termination
- Either party may end these terms at the end of a subscription period.
- We may suspend access to stop a security threat, unlawful recording or a serious breach of the acceptable use policy, with notice where practical, and restore it once the cause is fixed.
- Either party may end these terms if the other materially breaches them and does not fix the breach within 30 days of notice.
- After termination, the Organization has 30 days to export its data. We then delete Customer Data as the retention schedule states.
22. Disputes
These terms are governed by California law. The state and federal courts in Los Angeles County, California have exclusive jurisdiction, and either party may bring a claim within its limits in small claims court. Before filing, a party sends a written description of the dispute and both try in good faith for 30 days to resolve it.
23. Changes
We give at least 30 days' notice of material changes to org admins and users, by email or in the app. A change that reduces the Organization's rights or adds cost takes effect at its next renewal, unless the law requires it sooner.
24. General and contact
These terms, the documents they include and any order form are the whole agreement. Neither party may assign them without consent, except to a successor in a merger or sale with notice. Neither party is liable for delays caused by events beyond its reasonable control. If a provision is unenforceable, the rest stays in force. Notices to us: support@truesit.ai .
TrueSit acceptable use policy
Version 1.0. Effective October 17, 2026.
Recording: tell first
- Say the consent line before recording wherever the app asks for it, and confirm it in the app only after you said it.
- Use the line the app shows for the kind of visit. In a Ride-along sit, the line says a manager may listen live; use it whenever a manager may follow the visit.
- If anyone says no, do not record. If anyone asks you to pause or stop, do it at once.
- Tell anyone who joins during the visit (a second decision-maker, a relative, a neighbor) that you are recording, and stop if they object.
- In a canvass session, say the door line at each door before the conversation goes on. Confirm only when it was said. An unanswered reminder does not hold or delete the recording; the rep and company remain responsible for consent.
- Record only visits you are part of. Never leave the phone recording in a room you have left, and never record a conversation you are not in.
- Never hide the recording, disguise the app or tell someone you are not recording when you are.
Children and private moments
- Do not try to record children. If a child joins the conversation, keep to the appointment and pause if the conversation turns private.
- Pause during private family matters, phone calls the homeowner takes, and anything unrelated to the visit.
Photos
- Photograph the project: samples, the room, the old unit.
- Avoid people, children, documents, screens, mail and anything with personal details. If one is caught by accident, remove the photo.
Data you handle
- Use homeowners' details only for the visit and the company's follow-up.
- Do not export, download, screenshot or share recordings or transcripts outside what your role and your company allow.
- Do not use TrueSit to recognize or track a person by voice across visits, or to build a profile of a homeowner beyond the project.
- Do not use AI output as the only basis for a decision about a rep's job.
Misuse of the service
Do not:
- record or upload content you have no right to, or that breaks the law;
- harass, threaten, discriminate against or deceive anyone;
- break into accounts, probe or overload the service, or get around usage limits or security;
- reverse engineer, copy or resell the service, or use it to build a competing product;
- use the AI features to produce unlawful, abusive or misleading content, or to get the models to ignore their instructions;
- share sign-in methods or API tokens, or let people outside your organization use your account;
- send spam or unsolicited messages through any feature.
Reporting and enforcement
Report misuse or a security issue to support@truesit.ai. We may remove content, suspend a user or suspend an account to stop a breach of this policy, with notice where practical, as the terms of use describe.
Compliance kit for organization admins
Version 1.0. Effective October 17, 2026.
1. Check consent for your states
The Get started checklist links here. Before the first sit:
- Open Settings, then the consent table, and check every state where your reps sell.
- Leave the line required everywhere unless your counsel confirms a state needs only one party's consent for in-person conversations.
- Choose the line your reps say (the defaults are in section 3).
- Print or share the homeowner card (section 4), in English and Spanish if your reps visit Spanish-speaking households.
- Give your reps the notices in sections 5 and 6 where your states require them, and keep their acknowledgments.
- Decide your retention periods and whether to turn on product improvement (off by default).
2. The default consent table
Every state starts with the line required by the company's policy. The brief shows the reminder and an optional "I said it" confirmation. Neither "required" nor "recommended" blocks or delays recording. The rep and company remain responsible for consent; analysis flags a missing disclosure. An organization can change the reminder to "recommended" only for states allowed by the current table.

The state comes from the appointment's address, or the rep's home state when the appointment has none. Other laws to note by state: biometric laws in Illinois, Texas, Washington and Colorado (the voiceprint policy covers them); electronic monitoring notices in New York, Connecticut and Delaware (section 5); AI in employment rules in Illinois, Colorado and California (section 6).
3. The lines your reps say
The app shows the right line for the kind of visit and keeps its version on the sit:
- Standard sit: "I record my appointments so I can give you an accurate quote. Is that all right with both of you?"
- Ride-along sit, when a manager may listen live: "I record my appointments so I can give you an accurate quote, and a manager may listen live to help. Is that all right with both of you?"
- Canvass, at each door: "I record my conversations at the door for training. Is that all right?" Confirmation is optional in the app; an unanswered reminder never holds processing or deletes the segment.
4. The homeowner card
The full card is the recording notice (https://truesit.ai/privacy/#recording-notice, and in Spanish https://truesit.ai/privacy/#recording-notice-es). The rep shows it on the phone before starting. For a printed card or a leave-behind, use this short version with the QR code to the full page:
This visit may be recorded
Your sales representative records visits with the TrueSit app so their company can help them improve and keep an accurate record of what was offered. You can say no or ask them to stop at any time, and the visit goes on the same way. Your voice is never enrolled or used to recognize you. To ask for a copy or deletion, tell the rep, contact [Company], or write to support@truesit.ai with the date and address of the visit. Full notice: https://truesit.ai/privacy/#recording-notice
Aviso completo: https://truesit.ai/privacy/#recording-notice-es
5. Template: notice of electronic monitoring to reps
Adapt with your counsel. Some states require this notice in writing, an acknowledgment, and a posted copy.
Notice of recording and electronic monitoring
[Company] uses TrueSit, an app on your work phone or your own phone, to record the sales appointments and canvass conversations you choose to record.
- What is recorded. Audio from when you start a recording until you stop it or it stops itself; photos you add; your location at the start and end of a sit, only if you turn location on.
- What is produced. A transcript, a score against our sales process, the reason a sale did or did not close, and suggestions to help you improve, all made with AI and linked to the moments in the recording.
- Who sees it. You see your own sits. Managers and admins at [Company] see the sits of the reps they manage. In Ride-along sits a manager may follow the visit live. TrueSit's support staff see sit data only when needed to fix a problem, and every access is logged.
- What is private to you. Your private notes, your Mentor memory and your voiceprint. Nobody at [Company] can read them.
- Your voiceprint requires your written release. If you do not wish to enroll, contact the company before using recording features. The company may not penalize you for declining.
- Retention. Audio is kept [12] months and transcripts and scores [24] months.
- Questions. [Name, contact].
I acknowledge that I received this notice. Name, signature, date.
6. Template: notice of AI use in employment decisions
Adapt with your counsel. Some states require notice before AI is used in decisions about hiring, promotion, discipline, pay or termination, and some require an explanation or a human review.
How [Company] uses AI in reviewing sales visits
- What the AI does. TrueSit analyzes recordings of your sales visits. It finds the stages of our sales process you covered, suggests a score using fixed rules, and identifies the likely reason a sale did or did not close, with the transcript moments behind each finding.
- What it does not do. It does not make decisions about your job. A person at [Company] reviews the evidence before any decision.
- How results are used. For mentoring and to understand team results. [Describe any use in performance reviews, pay or discipline.] AI output is never the only basis for a decision about your job.
- Your options. You may ask [contact] for an explanation of a finding and for a human review of any decision that relied on it. You can also add your own score and reason on every sit before the AI's result is shown.
- Fairness. We review results across reps for unfair patterns at least [once a year].
- Contact. [Name, contact].
7. Keep up to date
When you add a state, a team or a new kind of visit, return to section 1. When TrueSit changes a default in this kit, we tell org admins by email.
